Terms of Service (TOS) For Patients / Users

By using the Service (as defined below), you agree that you have read, understood, accepted and agreed with the Terms of Use.

The Terms constitute an agreement between you and GetWell (referred to as the “Company”). The Company reserves the right to modify, alter, or change its Terms of Use and the policies governing it at any time as it deems fit.


1. Membership and Scope

The Company is a technology company and is not a medical or healthcare provider. By using the service, you are not entering into a contractual relationship between the Company. Your use of the Service is for your sole usage and purposes.

Membership serves as an access point between you and the Company and its Service. It does not equal to contractual relationship with the third party medical providers (GetWell Certified Partners).

While membership is an option, it is not a required component or prerequisite for the usage of the Service.


2. Procedures / Booking of Appointment

As a user of the Service, you are agreeing with the pre-defined procedures hereby set by the Company.

Booking of appointment is triggered and requested by you, as the user, with your preferred medical provider (GetWell Certified Partners) and your preferred schedule (date and time slot). Upon booking, you will receive a confirmation in form of email for the system acknowledgement of your request. This email does not mean the schedule has been accepted but is on the “pending confirmation” status by the preferred medical provider.  It is the discretion of the medical provider to accept and confirm your appointment request.


3. Cancellation

Cancellation is handled in multiple scenarios:

3.1  Cancellation by you (patient/user) before your payment transaction (Pending Payment Status)

In this scenario, no qualified booking has been made or requested because no payment is authorized. The booking request will be automatically deleted in our system within 24 hours of request.

3.2 Cancellation by you (patient/user) before the confirmation of the provider (Pending Confirmation Status)

In this scenario, cancellation cannot be requested by the patient/user as the payment has already been transacted and the doctor schedule has already been reserved (even prior to doctor confirmation). The request will automatically be routed and in case of no-show, booking and payment will be forfeited.

3.3 Cancellation by you (patient/user) after the confirmation of the provider (Confirmed Status), before or after the chosen schedule.

In this scenario, cancellation is not allowable. Booking and payment  will be forfeited.

3.4 Cancellation by doctor (GetWell Certified Partners) after their confirmation (Confirmed Status)

Doctors, due to the nature of their work, are allowable to cancel even confirmed appointments only if there is a necessity to attend to emergencies (e.g. surgeries, operations, etc).

As a user/patient, you understand and completely accept the possibility of this scenario. When this happens, you will receive a notification with the option to reschedule the appointment, or an option for refund.

Since payment has already been officially transacted with the official payment gateways of the Company, refund may be in form of GetWell credits/points that may be used within the Service.


4. Payment and Fees

4.1 Consultation Fees

Consultation fees are professional fees directly charged by the doctor or GetWell Certified Partners. These fees are non-negotiable and is pre-agreed between the doctors and the Company. Consultation fees of the doctors may be different with their usual charges for the non-users of appointment services (walk-ins). The doctors have the right to review and change their charges at any time without notification to the users/patient.

The Company observes the right to achieve standardization among the consultation fees and reject any pricing that are not at-par with the standards, for the purpose of creating price protection among the doctors.

4.2 Convenience Fee

The Company charges a fixed convenience fee of Php 150 for every user of the Service. The Company may also review this fee and may do changes if it deems fit.

Payment for both the consultation fee and convenience fee is charged instantly upon authorizing your cards. Cards can be Debit Cards, Credit Cards, or Prepaid Cards issued by major card issuers (e.g. Visa, Mastercard).


5. Privacy and Confidentiality

You shall maintain in confidence that all data and information pertaining your transaction (e.g. Credit Card Information, Medical Records, Doctor Information, Patient Personal Information) or account with the Company shall be kept secure and confidential, and will only be used to perform the Service.

Furthermore, employees, agents, officers and any affiliations of the Company will not disclose any information to any third parties without the written consent of the Company and you as the user.

However, as a confirmed patient/user, information will be necessary for the doctors (GetWell Certified Partners) and may be kept as records and official medical files of the patient. Such records will be handled by the doctors and may be used for whatever medical purpose they may serve.
